Insurance Bad Faith...

When you have an insurance policy with an insurance company, it is a contract that
both parties must honor.  You are obligated to pay the premiums when they come
due.  The insurance company, on the other hand, is obligated to pay all legitimate
claims you make on your policy.  

If you file a claim with your insurance company, they are required by Florida Law
to act in good faith in processing and paying legitimate claims.  Insurance bad faith
occurs when:

Legitimate claims are not paid on a timely basis
Legitimate claims are denied
Legitimate claims are underpaid

When you make a claim, unfortunately most insurers can't come right out and deny your claim immediately.  The insurance companies usually employ a list of standard
tactics that are designed to wear you down, make you give up, or force you to
agree to accept less than what you are legally owed.  For example, some insurance
companies claim they are sending your claim to  medical doctor for a second
opinion or to review your file.   These doctors are actually looking for any
preexisting conditions so they may deny your claim.  Some insurance companies do
not actually send your claim to a doctor, but to non-medical employees.  

Other times an insurance company will offer your a settlement that looks good, but
when you look at the actual number being offered to the amount of costs you will
amass due to property damage, medical bills, lost wages, etc., it will not be
enough.  Many policyholders will agree to the offer out of sheer desperation.  
Insurance companies count on this.

Insurance companies may also delay your treatment.  They may refuse to pay for
specialists or actually purposely delay the funds for the treatment.

If there is a large amount of money they may have to pay, insurers may hire their
own investigators or so-called experts to look "review" your  case,  with the intent
of uncover damaging information such as pre-existing conditions.

Insurance companies will usually demand extensive records from policy holders,
much of which is nearly impossible to Insurers will often demand records and
documents from policy holders that are practically impossible to obtain, such as
medical records from childhood, etc.

In other cases, insurance companies fail to settle a lawsuit filed against policy
holders when they had a duty to do so.  If an insurance company refuses to pay a
claim that should be paid, or offers to settle a claim for less than it knows the claim
is worth, or denies a claim without a proper investigation, this could give rise to a
bad faith claim against the insurance company.  

Bad faith insurance claims may also involve property insurance, health insurance,
auto insurance and other policies.  

Because the insurance companies are in a position of trust, they are held to a higher
standard.  In some cases, if you can prove that the insurance company acted in bad
faith, you can recover up to three times the amount of your insurance claim.
